As from 1 October 2017, companies with 7 or more employees are required to adopt a Code of Good Conduct to prevent and combat harassment at work, which must be properly publicised in the company, pursuant to Law. 73/2017 of 16 August 2017.

It will be up to each individual company to define the specific prevention measures to be implemented. However, we understand that such codes should, on the one hand, provide information about workers’ rights and, on the other hand, contain deterrent measures.

The absence of a Code of Good Conduct will make the company guilty of a serious administrative offence, punishable by fines ranging from €612.00 to €9,690.00 depending on the company’s turnover and degree of guilt.

The Code also provides for a duty to institute disciplinary proceedings whenever the employer becomes aware of alleged harassment at work.
